New white paper on the general data protection regulation from the danish ministry of justice
On May 24, 2017, the Danish Ministry of Justice published their long-awaited report on the Personal Data Regulation, which will establish the framework for the regulation of personal data in Denmark.
Report No. 1565 on the Data Protection Regulation and the legal framework for Danish legislation has been prepared by the Ministry of Justice in cooperation with all ministries, the Data Protection Agency, the Agency for Digitisation, and the Business Authority.
The report describes how the rules on data protection in the personal data regulation are to be understood, and in particular how they will be interpreted and implemented in the current legislation in Denmark. Together with a draft bill for a new act on personal data and various special guidelines, the report will form the basis for the Ministry of Justice's guidance on the EU Personal Data Regulation, which will enter into force in May 2018.
The draft proposal for a new act on personal data is expected to be presented to the Danish Parliament in the autumn of 2017. The bill must ensure that the Danish act on personal data complies with the new rules on data protection in the regulation, when the regulation enters into force on May 25, 2018.
The Ministry of Justice will issue special guidelines
The Ministry of Justice will regularly issue different guidelines to the act on personal data with specific guidance on special topics such as consent, data protection officer, cloud computing, registered’s rights, etc.
The special guidelines are expected to be published throughout the period September 2017 - January 2018. The final guideline is therefore expected to be issued only five months before the regulation enters into force.
